Condition Générales d'Utilisation

This document is a legal agreement between you and the company Timothée AUTIN, developer of E-walk. You agree that this document is enforceable like any written negotiated agreement signed by you. This document applies to your use of the E-walk mobile application, its plugins (like the IGN plugin), its website (https://ewalk.app), and services or any other materials made available by or on behalf of Timothée AUTIN to you (together the "Services").

Please read this document carefully. By using the Services, you agree to all its terms and conditions. If you do not agree, we will not license the Services to you and you will not be able to use the Services.

By using the Services, you also accept the Privacy Policy and the Terms Of Use of E-walk.

1) General information

1.1. Modification of conditions

This document may be updated from time to time for any reason. We will notify you of any changes by posting the new document here and informing you with a message in the application. You are advised to consult this document regularly for any changes, as continued use of the services is deemed approval of all changes.

1.2. Governing law

This document and any disputes arising under or in connection with this document (including any non-contractual claims or disputes) are subject to French law. The United Nations Convention on Contracts for the International Sales of Goods is hereby excluded from application to this document. All disputes arising out of this document (including any non-contractual claims or disputes) shall be settled by the French courts, which will have exclusive jurisdiction in respect of any such disputes. Should you have any questions concerning this document, or if you desire to contact Timothée AUTIN for any reason, please send an e-mail at eula@ewalk.app .

1.3. Definitions

For the purposes of this document, the terms below have the following meaning:

  • E-walk: Depending on the context, either the company Timothée AUTIN, publisher of the services, or the services themselves.
  • Services: The E-walk mobile application, its plugins (such as the IGN plugin), its website ( https://ewalk.app ), as well as any service or material made available to you by or in the name of Timothée AUTIN.
  • Application: The mobile application E-walk.
  • User: Natural or legal person using the services.
  • Member: User who created an E-walk account.
  • Subscriber: User who has taken out a paid subscription to some of the services.
  • Data: Any data made available by the services (such as a search result, a map, an itinerary).
  • Contribution: Data provided by a member.
  • Route: Activity route, offered by an E-walk member or by IGNrando'.
  • E-walk Topo Map: Worldwide topographic map available in the app or at https://map.ewalk.app .
  • IGNrando': The https://ignrando.fr website and its content.
  • OpenStreetMap: The https://www.openstreetmap.org collaborative project and its content.

2) Description of services

2.1. Data consultation

2.1.a) Search

E-walk's search engine takes its results from OpenStreetMap, and uses the Photon search engine.

2.1.b) E-walk Topo Map

E-walk Topo Map is a world topographic map that can be used free of charge in the application for online use (via an internet connection). It can be used offline for users having an E-walk Max subscription.

The use of E-walk Topo Map is strictly reserved for services, unless expressly mentioned in writing by Timothée AUTIN.

E-walk Topo Map uses the following data sources:

2.1.c) Other maps

The application also allows the consultation of other maps (such as Google Maps, Wikimedia Maps or IGN maps).

2.1.d) Routes

The services allow you to display routes for some activities (such as hiking). These routes are published by E-walk, by members of E-walk, or by members of IGNrando '.

The data published on E-walk featuring the IGNrando' logo comes from the collaborative site https://ignrando.fr. Only data published in public status and having been authorized by the contributor to mobile synchronization on partner applications are offered.

2.2. Contributions

The services allow members to send data to E-walk (such as a username, avatar or hiking route).

These member contributions are not always reviewed by E-walk. E-walk is not responsible for their content, does not necessarily endorse them and makes no warranty as to their accuracy.

The contributing member guarantees that its contribution:

  • belongs to him and that he has the right to send it, and that doing so does not infringe the rights of others (in particular in matters of intellectual property and privacy).
  • is not unlawful, obscene, defamatory, pornographic, threatening, hateful, racist, disrespectful or inappropriate.
  • does not incite inappropriate, reprehensible or law-breaking behavior.
  • does not advertise any product or service.
  • does not identify a minor, and that any identifiable adult has given him or her their explicit consent for this specific use.

In the case of an itinerary, the member must also ensure the practicability and accessibility of his itinerary, whether in terms of security or private property.

E-walk reserves the right to update and delete any contribution without notice, and if necessary to contact the member by email.

The contributions are public and accessible by all other users. By submitting a contribution, you grant E-walk a worldwide, royalty-free, non-exclusive, perpetual and irrevocable license to use it. E-walk can use your contribution without mentioning your name, without obtaining your authorization and without paying you any compensation, including for promotional or commercial purposes.

2.3. Sharing

Any user can share a contribution from another user by any mean, such as email or social networks.

By sending a contribution, you accept that it can be shared outside the services, and that E-walk no longer has any control over its future.

2.4. Account

Some features require the creation of an account (including viewing and sharing routes). The following rules apply to account creation:

  • the user must provide a valid email address.
  • it is forbidden to impersonate another user.
  • it is forbidden to use the E-walk logo and name.
  • the same natural or legal person can only create one account.

2.5. Purchases & subscriptions

Some features require purchase or subscription.

Purchases & subscriptions can be taken through the stores of Google, Apple or IGN, and follow the rules of the store concerned. These rules are recalled at the time of purchase.

3) Responsibility

3.1. E-walk responsibility

Data from multiple sources is presented to the user through the services. Every effort is made to ensure their quality, but E-walk declines all responsibility in the event of an error.

The data, whether offered directly by E-walk (such as search results, E-walk Topo Map or the user's location on the map) or indirectly (such as routes provided by members) are only indicative and do not engage the responsibility of E-walk in the event of direct or indirect damage resulting from their use.

If you find an error, you are invited to report it to contact@ewalk.app .

3.2. User responsibility

The user is fully responsible for his use of E-walk, his actions, and any damage he may cause to himself, to E-walk or to a third party.

He must ensure that current conditions, particularly wether conditions, are suitable for the practice of his activity.

Any member submitting a contribution must respect the rules of the section "2.2 Contributions".

4) Availability of services

Every effort is made to ensure availability of services 100% of the time. However, in the event of unavailability and for whatever reason, no compensation of any kind will be granted to the user.

5) Cancellation of services

5.1. By E-walk

E-walk may, at any time and without notice, cancel all or part of the services.

5.2. By the user

The user may, at any time and without notice, delete all or part of his contributions, including his account and the routes sent from it.

Deleting an account does not automatically delete routes sent with it. A user who also want to delete all of his routes can request it to contact@ewalk.app . By default, when an account is deleted, the routes created from it will remain available and E-walk will display "Deleted user" as the author of the route.
